This Privacy Notice for Opinionly LLC ("we," "us," or "our") describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you download and use our mobile application ("Opinionly"), or any other application of ours that links to this Privacy Notice.

Opinionly is a mobile app for giving and receiving honest feedback. You can post with your name or anonymously, and the people you are connected to can respond anonymously.

Questions or concerns? Reading this Privacy Notice will help you understand your privacy rights and choices. We are responsible for making decisions about how your personal information is processed. If you do not agree with our policies and practices, please do not use our Services. If you still have any questions or concerns, please contact us at hello@opinionly.io.

What personal information do we process? Your account details (your name, email address, and username), your profile, and everything you write in the app — posts, comments, and feedback messages. This includes content you post anonymously.

When you post or send feedback anonymously, other people using Opinionly are not shown your name and cannot find out who wrote it — your content appears under a stand-in name instead. We still keep a record of who wrote it. We need that record to run the service: to show you your own activity, to act on reports, and to remove your content if you delete your account. Our team can access that record.

Do we process any sensitive personal information? We do not ask for sensitive information. We do not collect your location, contacts, photos, camera or microphone, health data, financial data, browsing history, date of birth, or advertising identifiers. The app asks for no permissions other than notifications. Anything you type into a post, comment, or feedback message is stored by us, so please do not include sensitive details about yourself or anyone else.

Do we collect any information from third parties? If you sign in with Google or Apple, we receive basic account details from them — your email address, and (for Google) a link to your profile photo.

How do we process your information? We process your information to run the app, to keep it safe, to send you notifications you have asked for, to fix problems, and to comply with the law.

Do we check what people write? Before a post, comment, or message appears, we run an automated check on the text to look for content that breaks our rules. We use Google's cloud services, including their AI services, to help with this check. Our agreement with Google does not allow Google to use your text to train its AI models. We keep a record of the text and the result of each check — including for content that was never published. These records are kept indefinitely and are not deleted when you delete your account. Not every field in the app is checked this way.

In what situations and with which parties do we share personal information? We use two companies to run Opinionly:

Google. Opinionly runs on Google's cloud. Google handles sign-in, hosts our servers and database, delivers notifications, provides the AI services used for content checks, and provides our analytics and crash reporting.
Apple. If you sign in with Apple, Apple handles that sign-in. Apple also delivers notifications to iPhones.

We do not sell your personal information. We do not share it for advertising, and Opinionly shows no ads.

How do we keep your information safe? We use appropriate and reasonable security measures, both technical and organizational, designed to protect your personal information. But no way of sending information over the internet, and no way of storing it, can be guaranteed to be 100% secure. So we cannot promise that someone will never defeat our security and improperly access, steal, or change your information.

What are your rights? Depending on where you are located geographically, the applicable privacy law may mean you have certain rights regarding your personal information.

How do you exercise your rights? To ask about the information we hold, request a copy, or ask us to correct or delete something, email us at hello@opinionly.io. We handle these requests by hand. You can also delete your account yourself in the app at any time.

1. What Information Do We Collect?

Personal Information You Disclose to Us

In Short: We collect personal information that you provide to us.

We collect the personal information you give us when you create an account, when you use the app, or when you contact us.

Personal Information Provided by You. What we collect depends on how you use the app. It includes:

first and last name
email address
username
password — only if you sign up with an email and password. Your password is handled by our sign-in provider; we never see or store it.
your profile bio, if you write one
a link to your profile photo, if you sign in with Google. The photo itself stays with Google — we only store the web address. There is no photo upload in the app.
the posts, comments, and feedback messages you write — including ones you post anonymously
messages you write when you ask to connect with someone
who you connect with, who you mute or block, and what you like
reports you send us — the reason you pick and any note you write. We record which account filed the report so we can act on it. The person you report is never told who reported them.

Sensitive Information. We do not ask for sensitive information. We do not collect your location, contacts, photos from your camera roll, camera or microphone, health data, financial data, browsing history, date of birth, or advertising identifiers. The app asks for no permissions other than notifications. Please keep in mind that anything you type into a post, comment, or feedback message is stored by us — so please do not include sensitive details about yourself or anyone else.

Anonymous Posts and Feedback. When you post or send feedback anonymously, other people using Opinionly are not shown your name and cannot find out who wrote it — your content appears under a stand-in name instead. We still keep a record of who wrote it. We need that record to run the service: to show you your own activity, to act on reports, and to remove your content if you delete your account. Our team can access that record.

Content Checks. Before a post, comment, or message appears, we run an automated check on the text to look for content that breaks our rules. We use Google's cloud services, including their AI services, to help with this check.

We keep a record of the text and the result of each check — including for content that was never published because it did not pass. Before storing that record, we mask contact details such as email addresses, phone numbers, and web links. Anything else you wrote is stored as you wrote it, including any names you mention. These records are kept indefinitely and are not deleted when you delete your account. Only Opinionly's founders can access them.

Signing In With Google or Apple. You can sign in with your Google or Apple account instead of creating a password. If you do, we receive basic account details from them — your email address, and (for Google) a link to your profile photo. We do not receive your contacts or friends list.

Push Notifications. If you turn on notifications, we store a device token — the address Apple or Google uses to deliver messages to your phone — along with your notification settings. You can turn notifications off at any time in the app, or in your phone's settings.

Information Automatically Collected

In Short: Some information — such as the type of device you use and how you use the app — is collected automatically.

We automatically collect certain information when you use the app. Most of it is not tied to your name or contact details — we do not attach your account ID to a record of your own activity. But some of it records who or what you interacted with: for example, the account ID of a profile you viewed, or the ID of a post you liked. We could match those IDs back to real people using our own database. The information may include the type of device you use, its operating system, your language setting, and information about how and when you use the app. We do not collect your location.

The information we collect includes:

Device Data. Basic technical information about your phone: the device model, the operating system version, the app version, and a device identifier used to keep the app working correctly. This is not an advertising identifier — we do not collect or use those.
Log and Usage Data. Our servers keep technical logs. Each line records which part of the service was called, whether it worked, how long it took, and how big the response was. These logs do not include your account identifier or any of your personal information, so they are not linked to you. Separately, the app sends us error and crash reports so we can find and fix problems. The systems that run our service also see your device's IP address when it connects, as happens with any internet service; we do not store IP addresses in our own database.
Feature Records. We keep records of which app features were switched on for a given app installation, along with the app version and whether you are on iPhone or Android. When you delete your account, we delete these records and remove your account identifier from our feature settings.

We use Google's Firebase tools to collect this information — usage analytics, crash reports, and performance data. It goes from your phone to Google directly. We have a data-processing agreement with Google covering the information we send it. Google may also use some of the analytics information for its own purposes, to maintain and improve its services. We use it to keep the app running, to fix crashes, and to understand which features people use.

The Opinionly app does not use cookies. Our website, opinionly.io, does — you can find out more in our Cookie Notice. If you sign in with Google, Google's own sign-in page opens inside the app; that page is Google's, and it uses Google's cookies under Google's privacy policy.

2. How Do We Process Your Information?

In Short: We process your information to run the app, to keep it safe, to send you notifications you have asked for, to fix problems, and to comply with the law.

We process your personal information for these reasons:

To create and manage your account. So you can sign up, sign in, and keep your account in working order.
To let you use the app. So you can post, comment, like, connect with other people, and send and receive feedback.
To send you notifications. If you turn notifications on, we use your device's notification address to tell you about activity in the app. You can turn them off at any time in the app, or in your phone's settings.
To keep people safe and enforce our rules. We use your information to act on reports, to apply blocks and mutes, and to keep the app secure.
To find and fix problems. We use crash and performance information from the app to fix bugs and keep the app working.
To understand how the app is used. We look at how people use the app so we can improve it.
To meet our legal obligations. We may use your information to comply with the law, to respond to lawful requests, and to enforce our legal terms.

Posting without your name showing

Checking content before it is published

Before a post, comment, or message appears, we run an automated check on the text to look for content that breaks our rules. We use Google's cloud services, including their AI services, to help with this check.

The check covers your posts, comments, feedback messages, and the messages you write when you ask to connect with someone. Not every field in the app is checked this way. If you think a check got something wrong, email us at hello@opinionly.io.

3. What Legal Bases Do We Rely on to Process Your Personal Information?

In Short: We use your information to run the app, to keep it safe, and to meet our legal obligations. The only thing we ask your permission for is notifications.

Opinionly is intended for people in the United States, and this section is written for US privacy laws. Those laws do not require us to name a formal "legal basis" for each use of your information. Our reasons are the ones set out in How Do We Process Your Information? above: to run the app, to keep it safe, to send you notifications you have asked for, to fix problems, and to comply with the law.

Permission. The one thing we ask your permission for is notifications. If you turn notifications on and later change your mind, you can turn them off at any time in the app, or in your phone's settings.

4. When and With Whom Do We Share Your Personal Information?

In Short: Two companies help us run Opinionly: Google and Apple. We do not sell your information.

Companies that help us run Opinionly

Google. Opinionly runs on Google's cloud. Google handles sign-in, hosts our servers and database, delivers notifications, provides the AI services used for content checks, and provides our analytics and crash reporting.
Apple. If you sign in with Apple, Apple handles that sign-in. Apple also delivers notifications to iPhones.

These two companies handle your information for us. We have a data-processing agreement with Google covering the information we send it. Google may also use some of the analytics information for its own purposes, to maintain and improve its services. Google and Apple are the only companies we send your information to in order to run Opinionly.

We do not sell your personal information. We do not share it for advertising, and Opinionly shows no ads.

Other situations where your information is shared

Other users. Other people using Opinionly can see your profile, your posts and comments, and can interact with you. If you delete your account, we delete your posts and comments.
Reports you make. If you report someone, we can see who filed the report and what you wrote. The person you reported is not told who reported them.
Business Transfers. If Opinionly is ever sold, merged, or acquired, your information may transfer to the new owner. The same applies while we are negotiating a deal like that.

5. Do We Use Cookies and Other Tracking Technologies?

In Short: The Opinionly app does not use cookies. Our website uses Google Analytics cookies. We do not use any of this to advertise to you.

In the app

The Opinionly app does not use cookies.

We do use Google's analytics, crash-reporting, and performance tools inside the app, to understand how the app is used and to find and fix problems. We do not track you across other companies' apps or websites, and we do not use your information to show you ads.

One exception: if you choose to sign in with Google, Google's own sign-in page opens inside the app. That page is Google's, and it uses Google's cookies under Google's privacy policy.

On our website

On opinionly.io, we use Google Analytics to count visits and understand how the site is used. It sets two cookies: _ga and _ga_0LTL8FYB47. Analytics is the only kind of cookie our website sets — we set no advertising cookies. Our Cookie Notice lists them.

Google Analytics

We use Google Analytics on our website. It runs on every page, including our legal pages, and it also runs on teams.opinionly.io.

If you want to stop Google Analytics from measuring your visits to websites, you can install the Google Analytics Opt-out Browser Add-on. It works on websites you visit in a browser — it does not affect the Opinionly app. For more on how Google handles information, see the Google Privacy & Terms page.

6. Do We Offer Artificial Intelligence-Based Products?

In Short: Yes. Your posts, comments, and messages are checked automatically before they appear, and Google's AI services help us do that. You cannot turn this off.

We use AI in the app. It is not an optional feature you choose to try — you cannot turn it off. We use it for two things: checking what you write before other people see it, and offering to reword something before you send it. Both are explained below. No AI company other than Google receives what you write.

Checking What You Write

The copy of your text that goes to Google is masked in the same way: contact details taken out, everything else — including any names you mention — as you wrote it. Masking contact details does not make your text anonymous, so please keep that in mind when you write. Our agreement with Google does not allow Google to use your text to train its AI models.

The check covers your posts, comments, feedback messages, and the messages you write when you ask to connect with someone. Not everything you write is checked this way. Your profile bio, your name, your username, the stand-in name shown on your anonymous content, and any note you write when you report someone are not checked.

The check is automatic. If it finds a problem, your text can be blocked before anyone else sees it. Someone at Opinionly may read text that has been flagged, to check whether the decision was right.

Offering You a Rewrite

If something you wrote looks like it may be blocked, we may offer you a reworded version. You can accept it, change it, or ignore it.

While you decide, we hold on to your original wording with nothing masked. We delete it once you accept or decline. If you never answer — for example, you dismiss the suggestion or close the app — we may still be holding it until you delete your account.

7. How Do We Handle Sign-In With Google or Apple?

In Short: If you sign in with Google or Apple, we receive a limited amount of information about you from them.

You can create an account and sign in using your Google account or your Apple ID, instead of setting up a password with us. If you do, we receive some information about you from Google or Apple.

What we receive is limited: your email address and sign-in details, and — if you sign in with Google — the web address of your Google profile picture. We do not receive your contacts or a friends list, and we do not post anything to your Google or Apple account.

If you sign in with Google, we save the web address of your Google profile picture and show that picture on your Opinionly profile. There is no way to upload a photo in the app, so this is the only way a photo appears on your profile.

We use the information we receive only for the purposes described in this notice. Google and Apple also hold their own information about you, from the account you have with them. What they do with that is governed by their own privacy policies, not this one. We recommend you review their privacy notices to understand how they collect, use, and share your information.

8. Is Your Information Transferred Internationally?

In Short: Our servers are in the United States. If you use Opinionly from somewhere else, your information comes here.

Our servers are located in the United States. If you use Opinionly from outside the United States, your information is transferred to, stored in, and processed in the United States — by us, and by the companies that help us run Opinionly (see When and With Whom Do We Share Your Personal Information? above).

If you are in the European Economic Area (EEA), the United Kingdom, or Switzerland, your information will be sent to the United States, which may not have data protection laws as comprehensive as the ones where you live.

9. How Long Do We Keep Your Information?

In Short: We keep your account information for as long as your account is open. Some records are kept after you delete your account — we list them below.

We keep your account and the things you make in the app — your profile, your posts and comments, your likes, your connections, and your feedback messages — for as long as your account is open. When you delete your account, we delete them. We may keep information for longer where the law requires us to.

We keep reports and content decisions to keep the app safe — for example, so that deleting an account does not erase the record of complaints about it.

10. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We use appropriate and reasonable security measures, both technical and organizational, designed to protect the personal information we hold. But no way of sending information over the internet, and no way of storing it, can be guaranteed to be 100% secure. So we cannot promise that someone will never defeat our security and improperly access, steal, or change your information.

Who at Opinionly can see your information. Access is limited to the people who run Opinionly. Our team can access what you write, including content you post anonymously, and the record of who wrote it. We look at it when there is a reason to — for example, to look into a report, or to check a decision about content. The records of our automated content checks are more restricted: only Opinionly's founders can access those. Other people using Opinionly cannot find out who wrote content you post anonymously, but we can see who wrote it. We cannot offer you anonymity from Opinionly itself.

11. What Are Your Privacy Rights?

In Short: You can review or change your account details, or delete your account, at any time in the app. Depending on where you live, you may also have extra rights over your personal information.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under data protection law. These may include the right to:

ask what personal information we hold about you, and ask for a copy of it
ask us to correct information that is wrong
ask us to delete your personal information
ask us to limit how we use your personal information
ask us to send a copy of your personal information to you or, where the law provides for it, to another company
object to how we use your personal information, in certain circumstances
not have decisions about you made only by automated means

We will consider and act on any request in line with the data protection law that applies to you.

To ask about the information we hold, request a copy, or ask us to correct or delete something, email us at hello@opinionly.io. We handle these requests by hand. You can also delete your account yourself in the app at any time.

Automated checks. Text you submit is checked automatically before it is published, and that check can stop it from being published. If you think a check got something wrong, email us at hello@opinionly.io and we will look at it.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State Data Protection Authority or UK Data Protection Authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing Your Consent

The only thing we ask your permission for is sending you notifications. You can withdraw that permission at any time by turning notifications off in the app, or in your phone's settings.

Account Information

You can review or change your account details at any time in the app, in Settings.

You can delete your account in the app, under Settings. Deleting is immediate and permanent — there is no waiting period and no way to undo it or recover your account afterwards. Your posts, comments, likes, connections, and feedback messages are erased straight away.

Some records are kept after you delete your account. We list them in How Long Do We Keep Your Information? above.

If something goes wrong while your account is being deleted, email us at hello@opinionly.io and we will finish it by hand.

Cookies: The Opinionly app does not set cookies of its own. If you sign in with Google, Google's own sign-in page appears, and that page uses Google's cookies under Google's privacy policy. Our website uses Google Analytics cookies to count visitors. You can set your browser to remove or reject cookies; nothing on our website will stop working if you do. For more, see our Cookie Notice.

12. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") setting you can turn on to signal that you do not want your online activity tracked. There is no agreed technical standard for recognizing these signals, so we do not respond to them. California law requires us to tell you that. If a standard is adopted that we have to follow, we will say so in an updated version of this Privacy Notice.

To be clear about what this means for you: we do not track what you do on other companies' websites or apps, and we do not use advertising identifiers. So there is nothing a Do-Not-Track signal would turn off.

13. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.

Sources of Personal Information

We get personal information from four places:

From you — when you fill in your profile and when you write posts, comments, and feedback messages.
From your device — your phone automatically sends information about how the app is used, along with crash reports, to the tools we use to run and improve Opinionly.
From the account you sign in with — if you sign in with Google or Apple, they confirm who you are and give us your email address. Google also gives us the web address of your profile photo.
From other people — what other people write about you, including reports other users file about you.

Will your information be shared with anyone else?

We disclose personal information to the companies that run our technology for us. We have a data-processing agreement with Google covering the information we send it. Today those companies are:

Google. Opinionly runs on Google's cloud. Google handles sign-in, hosts our servers and database, delivers notifications, provides the AI services used for content checks, and provides our analytics and crash reporting.
Apple. If you sign in with Apple, Apple handles that sign-in. Apple also delivers notifications to iPhones.

We do not sell your personal information. We do not share it for advertising, and Opinionly shows no ads. That was true for the past twelve (12) months, and we do not plan to change it.

Your Rights

You have rights under certain U.S. state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:

Right to know whether or not we are processing your personal data
Right to access your personal data
Right to correct inaccuracies in your personal data
Right to request the deletion of your personal data
Right to obtain a copy of the personal data you previously shared with us
Right to non-discrimination for exercising your rights
Right to opt out of the processing of your personal data if it is used for targeted advertising (or sharing as defined under California’s privacy law), the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects ("profiling")

We do not sell your personal information. We do not share it for advertising, and Opinionly shows no ads. We do not use your information to build profiles about you. So there is nothing here for you to opt out of. If that ever changes, we will update this notice and give you a way to opt out.

When you delete your account. You can delete your account in the app, under Settings. Deleting is immediate and permanent — there is no waiting period and no way to undo it or recover your account afterwards. Your posts, comments, likes, connections, and feedback messages are erased straight away.

How to Exercise Your Rights

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent who does not provide proof that you validly authorized them to act for you.

Request Verification

When you email us a request, we need to check that you are who you say you are. We do that by matching the details in your request against what we already hold — usually the email address on your account. If we cannot tell that it is you, we may ask you for more information. We only use what you send us to check your identity and to handle your request.

If someone makes a request for you, we may ask them for written permission signed by you, and we may ask for more information to confirm your identity.

Appeals

Under certain U.S. state data protection laws, if we decline to act on your request, you can appeal by emailing us at hello@opinionly.io. We will write back to tell you what we decided and why. If we deny your appeal, you can complain to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, lets California residents ask us once a year, free of charge, what personal information we gave to other companies for their own direct marketing, and who those companies were.

We do not share your personal information with anyone else for their direct marketing, so there is nothing to report. If you are a California resident and would like to make a Shine The Light request anyway, email us at hello@opinionly.io.

14. Do We Make Updates to This Notice?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be shown by a new date at the top of this Privacy Notice. If we make important changes, we may tell you by posting a notice or by sending you a notification. We encourage you to review this Privacy Notice from time to time.

16. How Can You Review, Update, or Delete the Data We Collect From You?

You have the right to ask what personal information we hold about you, to ask for details of how we have used it, to correct anything that is wrong, and to ask us to delete it. These rights may be limited in some cases by applicable law.

Two things are worth knowing before you delete your account: it happens straight away and cannot be undone, and a few records stay afterwards. We list them in How Long Do We Keep Your Information?.

17. Do We Collect Information From Minors?

In Short: Opinionly is not for people under 16, and we do not knowingly collect information from children.

Opinionly is not intended for people under 16. The App Store lists Opinionly as 16+.

We do not knowingly collect information from children. We do not ask for your date of birth, so we do not check your age in the app.

If you believe someone under 16 is using Opinionly, email us at hello@opinionly.io and we will remove the account.
